I am considering starting a small part-time business out of my house. The purpose of the business would be to copy cassettes, albums, home movies, VHS, film, and other personally owned media to CD's or DVD's for their own personal use. Is this legal to do?

Hello,

Copyright law allows a copy of a "media shift" as long as the result is not for commercial gain, or purpose.

USC Title 17 501 and 506.

What you should do is have an agreement with all your customers that says they have the license for the copyright material, and they have confirmed that license does permit the replication for PERSONAL and non duplicate use. Further they undertake to INDEMNIFY and hold you harmless for any claim that may arise out of the copy, and any liability that may be adjudicated on you shall be limited to the value of the invoiced services They are only compensating your for your time and expertise, and not paying for the physical copy. (don't have a per copy fee, have a "time" fee).

Something to that effect, properly registered in your state (preferably as a coporation) will be fine.

Good luck!!
