My Fiance and his mother own a home in Orange County, Orlando, Florida. His mother has a life estate and he has a remainder interest. They entered into a contract with the next door neighbor to sell the home for $110K dollars. His mother has lived in the home for over 15 years, but was considering moving to New Jersey to live with her only son. She is 93 years old. Through the years the neighbor expressed interest in buying the home, so before she came to New Jersey for a few weeks in July, her son, my fiance spoke with the neighbor and told him they would sell for $110K flat. Ultimately, a FL contract was signed stating that Seller would pay for title search/abstract. Also, there was a specific performance clause in the contract. The Seller's have since changed their minds and have been told by Buyer's attorney that they will be sued for specific performance under the terms of the contract. Are Orlando Courts likely to enforce specific performance?
