if an hourly employee is being harassed, and he/she request a meeting with H.R dept, does the employee have the right to request another hourly employee to sit in on the meeting as a witness only? I work in a can industry as a spray machine operator, i'm a woman, my nite supervisor has cursed me several times, he has a history of intimidation..He even hit things that i was standing beside in my dept... I don't think he want a female in my dept. I have tried to tolerate his verbal abuse...I have been to H.R. on several different times...He scared me so bad the last time, I requested a meeting with H.R, Plant supertindent, and, my plant mgr...But, with all management present, i wanted an hourly employee to sit in on the meeting in the capacity of a witness only. H.R personnel denied my request

In South Carolina, when you are filing an informal complaint, you are not necessarily required to have a witness present. However, if you are being accused of something, you do have a right to have a witness present.

If you are filing a formal charge of discrimination or disparate treatment, you have the right to have a witness present.
