My wife and I signed a lease agreement for a house from another married couple that lives in Texas(we live in Mississippi). We received a letter from the trustee of the estate (house was left to children of "landlord"-didn't not know situation of house, but found out 12/20/06) stating if we didn't not contact him immediately that we could it could hinder our "further occupancy of this house." Since, the "landlords" weren't the rightful representatives of the house does this mean our lease isn't legal

Hello Customer (name blocked for privacy) and welcome to Just Answer.

No, if the married couple are not the owners or rightful representatives of the home, they would not have had the authority to enter into a binding contract for the home.

However, the children of the landlord do not want to allow you to move in, want to change the conditions of the lease significantly, and by doing so, they have caused you hardship, you may be able to pursue the married couple for misrepresentation for entering into a contract for the property. I recommend that you contact the Lawyer Referral Service to explore your options regarding this matter. The lawyer referral service will provide a 1/2 hour consultation for $25. The children are of the married couple in Texas(The house was left to them in the will). The trustee is the brother of the wife from the married couple. So, are you telling me that if the trustee wants to kick us out, I could pursue the married couple for damages to us and court costs?
