Independant Contractor ?

I have a ex employee who quit six months ago because he was not on the voicemail he was also a independant contractor, well we both worked for a company that did not pay us a commission owed and they are now Bankrupt, he is trying to sue me? is there a statute on time passed, also if I did not get paid do I owe him money?? No contract was ever signed by him please help
