as a employer of 3 employees do i have to pay overtime

Reply to 4ren6's Post: we are electrical contractors i have 3 employees they get paid every week some weeks they work over 40 hrs, and some weeks they dont work 40 hrs but i still pay 40 hrs; so do i have to pay overtime thank you shelly

Ok, here are the laws as they appear now.

I would also suggest contacting the Texas Department of Labor direct as well. If they are subcontracted out or paid by the job this may not apply. The best way to know for your specific State is to call.

This is correct. The amount is based on the total yearly salary.

Under the new FairPay rules, workers earning less than $23,660 per year - or $455 per week - are guaranteed overtime protection.

However, since they are in a trade area I would strongly suggest calling your local texas department of labor to verify this. Certain trades are exempt thus the need to verify at the Texas level for your States Code on this.
