I need asome expert advice. I have a up stairs neighbor that keeps giving my 8 year old son problems. The man is 71 and has no kids ,never been married and has no family . I know that he is misserable but he seems to have it out for my son.He has even started with him in our own home. My son is afraid to be around him. I have 3 other children that he never bothers. My son has never called him a name the only thing he is guilty of is telling me when he feels threatened by this man, and looking at him when heis disaplined to see if he says any thing about it . I have a 4 year old that has swore at the man kicked the man and spit in his face and nothing was ever said ,he just looked the other way. also he called my son a brat, jurk and a couple of other names[ he even told my son that he hated him]. the other day he had me so stressed and up set that I started to cry . he told my so that it was his fault[my son that is]and not his. my son is starting to come down with depression because this man keeps knocking his self esteem down. I have no money to move [ plus we have a land contract on the house ,so we kind of are tied to the house. ] is ther any leagle routs to turn. For my childs sake.

If you feel that your life or the life of your children is in immediate jeapordy then you should contact the police immediately. The police will know what to do and they can give you the guidance on what your options are. One of these options might be to file an Order of Protection or Restraining Order. The court determines whether the order is warranted, but once granted the indivdual in question cannot be near you or your children and if violated, the police can intervene. You should contact the courts to find out more about free legal help. check out www.nolo.com for legal guidance in your state to see if the facts warrant an order of protection and step-by-step guidance on how to prepare the document. You can also visit and read the following link for help. http://www.womenslaw.org/NY/NY_how_to.htm
