About 10 years ago I was harrassed at work by a collegue. I ended up being fired because of her. I was fired because I witnessed her abusing patients and turned her in to the administrator of the facility. We both worked at the facility under a contract for services owned by our boss.I went my way a never looked back until last week. I was filling in at a clinic for a person on vacation and who do I run into? HER She also was filling in. We are healthcare providers. I saw her and immediately walked out and came in the back door. She proceeded to tell the patient she was working with that I was fired for committing fraud. This is abolutely not true. This patient happens be a nurse who works in a large facility in my town. The owner of the clinic called me and told me what had happened because the patient asked her about it. The clinic owner is quite upset because of the implications for her business. What was said was not true but I''m sure it will do damage. What can I do?

Hello and thanks so much for choosing this forum to pose your important legal question. I will do my best to give you some honest and accurate guidance.

  1. I would start by making it as clear as possible to the owner of the clinic about the circumstances of the prior incident. If you have access to the documents, you could show her the report you filed 10 years ago (with any protected health care information redacted). I would stress that you took action based on your concern for patient care. Unfortunately, the other party seems to have a vendetta against for and is retaliating. I would also stress how utterly inappropriate and unprofessional it was for her to share anything about this with the patient.
  2. I would also send the other person a cease and desist letter via certified mail--return receipt requested (retain a copy for your records). Simply state that you have knowledge she is engaging in legal actionable behavior, insist the she immediately refrain from doing so and not begin the conduct again, or else you will be forced to take legal action against her.
  3. If it persists, you may have a cause of action against her for defamation and damages for harming your professional reputation and career opportunities.
  4. You would also do well to consult a local licensed attorney if the matter continues to disrupt your life.
  5. If the other person holds an occupational license (i.e. RN, LPN, CNA) you could certainly contact the regulatory board to discuss possible charges for unprofessional conduct.
