My sister has just left a gay relationship in Colorado ...
Sent to Legal Experts July 09 05:51 PM

My sister has just left a gay relationship in Colorado after 11 years. When she started the relationship she moved into the other lady's home. For 7 years she paid half of everything. When the home was sold her partner got over $160,000. they put this money towards the purchase of a new home. My sister gave $2,000.00 towards the downpayment and the $151,000 was given by her partner. Now they have decided to split up and the partner is saying my sister is only entitled to $2000 plus 50% of any equitey earned and the other money is strictly hers! Does my sister have any rights? Isn't she entitled to 50% of whatever the home was worth when she moved in and the difference of what they sold it for and once this new home is sold she can get her equity from the previous sale?   They also purchased a Timeshare that my sister did not want and now she is stuck paying. What choices doe she have?

Thank you
Patricia Short

Dear Customer (name blocked for privacy),

There is no entitlement based on co-habitation in non-marital and now non-civil union relationships.

Any entitlement would have to be determined by the court based on rules of contract law.

She has the right to sue for what she considers to be an equitable distribution based on a normal rules of equal partners in a contractual partnership.
