The dispute centers on a solicitor who sold properties for myself and then puchased a house ofr my wife. The funding of whihc came form

a Sale of previous house £135.000
b proceeds from myself via solicitor £140.000

Solicitor now claims and has riased initial writ for a sum of £50k against my wife. No loan agreement exist and no statement of movement of funds from my sale or the sale of previous house has been provided by lawyer. The sums involved from the sale of my own proeprties were about £1.2mill pounds less mortgages of about £500k

I want to defend action myself and need to know what is required to prove a loan contract exist between my wife and lawyer.

The solicitor has refused to provide statements of movement of cash, for over two years.

With no loan agreement signed by my wife, how can he demonstrate a loan exist other than trying to prove a contract was entered into for the loan, if he did provide any loan, which I am unable to say at the present time ??

I understand a credit license is a prerequiste in Scotland, does this mean a solicitor will be required by statue to hold such a license or does his law society membership cover this ??
