My granddaughter attends third grade in Burlington, WV. Her grade average is 67 and the teacher is saying that she is going to fail her. Will the No child Left Behind Law keep her from failing. Thank You, Lois

Already Tried:
My daughter-in-law went to the school several times to talk with the teacher. The teacher told her that if the child was attending school in Keyser, WV that they would pass her, but they have different guide lines in Burlington, WV. It is a small school. I thought the purpose of the NCLB Law was to protect the child so that the child wasn't left behind.

Hello,

The NCLB requires states to develop assessments in basic skills to be given to all students in certain grades, if those states are to receive federal funding for schools. It has nothing to do with holding a child back in a grade. It requires schools to set certain standards for the children and if the school fails to do so then the school is held accountable.

Holding a child back a grade is set by county and state standards. If the child's grades are not at the set standard then the child is held back so they do not fall behind in the next grade. If you feel the child should not be held back you have the right to consult with the principle as well as the school board.
