The NCLB requires states to develop assessments in basic skills to be given to all students in certain grades, if those states are to receive federal funding for schools. It has nothing to do with holding a child back in a grade. It requires schools to set certain standards for the children and if the school fails to do so then the school is held accountable.
Holding a child back a grade is set by county and state standards. If the child's grades are not at the set standard then the child is held back so they do not fall behind in the next grade. If you feel the child should not be held back you have the right to consult with the principle as well as the school board.
