Hi, I have been living with a man for the past year who is a paranoid schizophrenic. I am his girlfriend and I take care of this man. Recently I asked him about getting a job and he went ballistic, he threw a boot at me, knocked over the Christmas tree and then called the police and had me arrested for tresspassing. He lied to the police, told them we had been broken up for several days and that I had moved out. We live in Indiana, I lived in the home again until the preliminary hearing when I received a no contact order until the trial. what are my rights to reside in the home and not be removed from the home where I live by the police, even though I am not on the deed? I pay some of the bills there. This man cannot live alone.

I have been a California lawyer for a long time, but I am sure the situation would be identical in Indiana.

There must have been testimony by both police officers, as well as statements by your boyfriend, for you to have been ordered no contact prior to the trial.

Your statements to Just Answer are only one side of the case, and while you may not want to hear it, you'll be arrested if you try to reside at the home. If the man can't live alone, your best way to help him is to find somebody who will help him, while you aren't in the house.

I wish you the best, but use your energy before court to find other help for him.

Also, you wouldn't have been held for a trial (at your preliminary hearing), without enough evidence against you for the judge to hold you for trial.

You should be focusing on criminal charges against you, instead of resuming this difficult relationship.

Reply to bbironsides's Post: i know that, my question was what were my rights to not being arrested in the first placed for being on the property where I live. I know for a fact that police can't remove people from homes where they live without a court order. They believed a paranoid schizophrenic without any evidence that I did not live there. My civil rights were violated, no one should be subjected to this kind of treatent. I am contacting Sam's family to see if they will have a commitment hearing for him.
