Sent to Legal Experts December 08, 2007 3:07 p.m.

our lawyer kept a judge's ruling to meet and confer from us, conspired with opposing party's counsel, which opposing counsel used against us in motions, advised us he was following our instructions and then did not do so, wrote and charged for emails to opposing counsel that talked badly about us. Is this a matter for an ethics board or malpractice?

Hello Customer (name blocked for privacy),

If you are sure of your facts, you need to start out writing to your lawyer and ask for a complete accounting of what he has done on your behalf, and ask for an explanation of the emails and other problems. Then, if you are not satisified, you need to report the concerns to the ethics board in California. There is a separate Bar Association in almost every county in California, and you should start at the local Bar. You might resort to a malpractice claim if you have lost a lot of money. I would go through the local Bar first.
