How do I set up a conservatorship for a disabled adult in California? Must it be done through the court system?

In California you will need to file a petition to become appointed as a conservator for a disabled person. You will need to file the necessary documents in Probate court and the Probate Judge will make the determination if 1) the person requires a conservatorships and 2) whether you qualify to take the role of conservator.

The court process is required as the order of conservatorship will limit the person's right to make their own decisions and their rights need to be protected. California has excellant resources that you can read about here.

Note that although the website has the conservatorship materials in the seniors sections, it is applicable for any person.
