My son has been served with papers from a

My son has been served with papers from a collection agency on some old Legal Fees in the amount of 5800.00. He was able to borrow this amount from a family member. He called the collection agency to discuss a possible settlement on this amount. Of course they are holding out for every dime. They stated they could not accept that amount and stated that in fact an additional amount of 1600.00 for interest and court cost would be necesary in order for this to not go to court in 7 days. He can not get anymore funds for this. He was hoping for a settlement so he would not have a judgement showing against him. So he only has it seems a couple of alternatives i seems. If he goes to court will he be given the opportunity to set up repayment terms through the court? Would any leins on property be placed at that time. Or would he be better off filing Chapter 13.
