Sent to Legal Experts October 15, 2007 8:54 p.m.

I rec'd a call from an attorney's office at 8:15pm wanting my SS# and stated that since I would not give them my number I would be receiving a letter from them and then I needed to call the phone number given to me concerning a unsecured debt that Midland Credit had contacted them..........I don't work,my husband and I have tried to pay this credit card debt but they keep adding interest, a 8,000 debt is now over 25,000. What are my rights, I don't have anything in my name, they say they will place a judgment against me, I live in North Carolina, What can I do?

First of all, NEVER give your social security number to ANYONE......especially over the phone. If they were a legitimate attorney's office they would NOT have asked you for this information. Many collection agencies falsify that they are attorney's offices and try to scare people into paying debts that sometimes they do not even owe! My suggestion to you is to simply hang up on them the next time they call as they are harassing you and will only continue to use insensitive tactics to try and guilt you into paying them one payment so that they will have grounds to collect on the full amount. They want you to admit that you owe the debit so that they can extend this to try and collect it. I will tell you what a bankruptcy attorney once said and that is until you have a paper from the court stating that you have to be in court for a hearing on this, do not worry about it. If a collection agency has this then it means your credit card company has already written it off. The statute for them to collect in your state is only 3-5 years but it can start again everytime a new collection agency buys your account, read more HERE and HERE.
