I just recieved a check from the insurance company for my totalled car, my family has been waiting for this check for some time and had it next dayed. However, the wording on the check worries us that they are trying to close out the whole claim(medical) and not just the car(as discussed with company). I need help understanding the wording on the check. ASAP!

Do you have an attorney that is handling your case? If you do, call the attorney. If not, call the insurance company.

Does any one in your family have injuries and still receiving medical care? If so, I would not cash the check as it states discharge from all claims.

I have to agree with you, the wording is a bit unclear. If you have any outstanding issues that need to be settled, cashing the check could impact further claims.

If you sign and cash the check you will have no future claim or claims that are valid and legal. The cashing of this check will settle all litigation with this company. Do not sign it nor accept it if your not satisfied with the amount or if you have concerns for future medical or litigation proceedings. Let me know if you need further assistance on this.

Reply to Medicine's Post: It is Saturaday and know one is in their offices. We do have medical claims that have not been settled yet. The insurance company in past offers for the car have said that the car and the medical claims are separate however we accepted a new offer on the car after haggeling for sometime, and the wording on the check made us wonder if they are trying to pull a fast one. So, you don't think we should cash the check?
