(Not a Legal Question?)

cracked patio
Sent to Legal Experts August 27 01:39 PM

What are my legal rights when a contractor won't repair a faulty job? I hired a company to pour a 500sq ft. patio in my backyard. Firts off, the color is wrong. Secondly, it developed major cracks within 30 days. Contractor keeps promising to fix it but so far, nothing. I've called him repeatedly. It's been 4 months. I paid him $2,300.00 I live in AZ. Thanks in advance!

Assuming that your contractor is licensed by the State of Arizona -- you can file a complaint with the state licensing authority for contractors -- which is the Arizona Registrar of Contractors.

Here is a link to their Complaint Form (pdf).

If your contractor is NOT licensed -- you can still contact the above agency but I doubt they can be of much help.

The other alternative (especially if the contractor is not licensed) is to file a claim in Arizona Small Claims Court.  Thankfully, your case is within their dollar limit which is $2,500.00.

Assuming that you have the original contractor to provide a repair/remedy to your problem -- you may want to retain a separate contractor (for a small fee) to look at the problem and make recommendations regarding a repair/remedy.  You could also have this contractor inspect the repair/remedy -- after your original completes it (and before you 'accept' the work) as some assurance that the repair/remedy was done correctly.

Good Luck!

As I am not an attorney, the above should not be construed, or relied upon, as legal advice.  I strongly advise you to check with a competent attorney to confirm that what I have told you is both correct and complete.
