Child Support

My boyfriend and I had a baby on 5/31/05. I told him that I needed him to pay some child support. He said that he would get her (our daughter) whatever she needs. I told him that I don't want to have to keep coming back and forth to him, that we have to decide on an amount he can pay each month. Finally, he came up with $100 per month. I told him that that was NOTHING, but he insists that that is all that he can pay. I know for a fact that he makes good money. He lives in a house that is already paid for. He just has to pay taxes. That house would sell for $425,000 on today's market, as per his words to me several times. Finally, to make a long story shorter, I agreed to the $100/mo...and $200 on the months that he is able. That was days ago. Tonight he told me that he had his lawyer draw up some papers for me to sign so that he doesn't have any problems down the line. I told him that his money order receipts are his proof of payment, but he said he may lose that. He wants me to sign the papers and then his lawyer is going to record it. I'm wondering whether I should just take him to court since I know that he is able to pay more, and since it is going to be documented, we may as well use a judge/mediator. Once the papers are recorded, my rent is going to go up because I am receiving Section 8 Rent subsidy. Also my disability check may decrease (I've been out on disability since 1995), once I notify them of this extra income. He has 3 other children, 1 is grown out living on her own. He has a teenage daughter that lives with him and a teenage son that may be coming to live with him soon...(most likely he will). My question is: What would you do in this situation??? Would you sign the papers for $100/$200 per month??? Would you go to court (I know that I would win and get a lot more, maybe not a lot, but at least $300 to $400 a month). By the way he is a mortgage broker part time and he also has his own construction business remodeling inside and outside of homes. What should I do???? We have been together for almost 3 years now and this is the first disagreement that we have had. We are still in love, but this is causing a rift between us. I don't feel that he is being fair. He keeps saying that all he has to pay is 17%. But I feel like he thinks that I am stupid because I know that $100 is no where near 17% of his pay. I hope this isn't too confusing. Is there any way that I can find out what amount he put down for income on his last tax return. Are tax returns public record??? I hate to be doing this, unfortunately it is necessary.

Greetings:

Unfortunately, you cannot receive information about his tax returns at this stage.

As far as the monies are concerned, you are entitled to receive the appropriate amount. The only way to receive same, is to go to court. Personally, the amount of monies that are being offered to you seems to be a nuisance fee (meaning a little something just to pacify you). Let the court decide the right amount.

You can contact a paralegal's office for assistance in helping you prepare the proper documentations to file in the court. If you do not have the money in which to do so (which happens to be less than seeking a personal attorney), you may wish to seek Legal Aid. Filing fees of any documents can be waived by the court due to your financial situation - and, in order for the court to waive the filing fees, you will need to file a waiver of costs (this is a form that the court provides).

You can inform your boyfriend and his attorney that you need time to think about the boyfriend's proposal....you don't have to sign - even if they try to force you - You have rights, and so does your child. Don't let them intimidate you. If your boyfriend is making a substantial sum of money, then you can be assured that you will get a reasonable sum for child support. Certainly, whatever the court decides will be a fair amount.
