I was contacted by a "attorney''s office" stating they were representing a company called Quik Payday Loans in Colorado. They were basically threatening that if I did not pay $460. they would have a local attorney take me to court and it would cost me $3000. I am in Alabama and I supposedly took out the loan via the internet in 2004. Is there a statute of limitations on this and what legal jurisdiction would apply. They did have my PO Box which they stated the payday loan company could not reach me through. I have had this box open since 1999.

Already Tried:
I called to ask general questions from the D.A.'s office. The woman that answered stated that they could swear out a warrant for theft if the loan is legitimate.

The statute of limitations based on a contract or promissory note is 6 years in Colorado. This means that if this debt is yours, they still have the ability to pursue it.

Although they do not have the right to "threaten" you. The attorneys do have a right to let you know how much it will cost you to settle the debt now, versus settling it if they need to take legal action or impose penalties.

FYI for your database, while I was waiting I was further searching for information on this attorney. He appears to be quite shady and has several lawsuits outastanding against him. Christopher Ranieri out of Florida. He is involved with the McKinnon group and is like all other credit collection agencies purchasing loans that are in default and then trying to pass himself off as something other than a third party collection agency. His modus operandi appears to be strong arm tactics and threats.
