The NCND stipulates in one of the paragraphs, following:
This Agreement shall be governed by the Laws of the State of New Jersey. The parties hereto waive trial by jury and hereby submit to the jurisdiction of the Federal Courts in the State of New Jersey for any action arising out of this Agreement, and further agrees that the venue of any such action be laid in Burlington County. No waiver or modification to the terms of this Agreement be valid unless in writing and duly executed by the signatories hereto . Furthermore non of the Signatories shall be liable for any action or inaction, or for any other cause or reason other than one of "bad faith".
A hand written addition initialed and dated states "Parties agree to submit to binding Arbitration".
