i was fired from my place of employment on April 21, 2006 ...

i was fired from my place of employment on April 21, 2006 because I am in the union I was able to go to arbertration on Aug 17, 2006.
I just receive my ruling on Jan 8, 2007 and my award isthe company did not have just cause to terminate Maurice Boyette because it has not sustaned it's burden to prove that he violated work rule#27. The company did have just caused to discipline Maurice Boyette for violating work rule #33. The grievant shall be reinstated as promptly as feasible but without backpay and without restoration of seniority and benefits from the date of the termination to the date of reinstatement. Based on this paragragh do I lose all my seniority or just for the 8 months? And is there any way I can sue for my back pay?

You will only be loosing the seniority for hte 8 months you were not working.

You have the right to sue, however, it will be a weak case because of, in this case your union association. Since you are a member of a union and filed an arbetration, you were essentially agreeeing to accep the outcome. You can always appeal an outcome.

Still courts have ruled in favor of the plaintiff,even in the face of binding arbitration. Especially if grevious harm has been caused. I think not getting back pay is horrible. My recommendation is to find an attorney who practices employement law and sit down face to face for a heart to heart talk and see if he agrees.
